Terms of Service

Artisan Letters provides a platform that allows users to create personalized letters ("Letters") online. Users are provided with a unique, unguessable link to access their hosted Letter. We also provide the static HTML code for the Letter immediately upon creation, allowing users to download and host the Letter independently.

While an account is not mandatory to generate a letter, we do require collection of data for mapping to generated letters.

• You must provide accurate and complete information.
• You are responsible for maintaining the confidentiality of your account information (including your email address) and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Ownership:

You retain ownership of the content of the Letters you create. By submitting content to Artisan Letters, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and make your Letter accessible via the unique link, and to provide the static HTML code to you.

Responsibility:

You are solely responsible for the content of your Letters. You agree not to create or share Letters that:

• Are illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Infringe upon any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Contain software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
• Constitute unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

Monitoring:

We have the right, but not the obligation, to monitor the content of Letters. We may remove or refuse to display any Letter that violates these Terms or that we deem objectionable, in our sole discretion.

No Guarantee of Availability:

We do not guarantee the continuous availability of the Service or any specific Letter.

Fees:

Artisan Letters is a commission-based service. Fees are determined on a per-project basis and agreed upon before work begins.

Payment:

We currently accept payments via Bank Transfers, PayPal, and GCash. Specific payment details and instructions will be provided on a per-project basis.

Refunds:

As this is a commission-based service, all sales are final. No refunds will be provided.

Our Content:

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Artisan Letters and its licensors. The Service is protected by copyright, trademark, and other laws of both the Philippines and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Artisan Letters.

User Content:

We do not claim ownership over your letters content.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN NO EVENT SHALL ARTISAN LETTERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

These Terms shall be governed and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through informal negotiation. You agree to contact us at [email protected] to attempt to resolve any dispute informally.

These Terms constitute the entire agreement between you and Artisan Letters regarding the use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
